ARTICLE 1 - PARTIES

1.2. BUYER

Individual or legal entity purchasing services under this agreement. Buyer information is recorded during the order process and processed into the customer profile with invoice details.

ARTICLE 2 - SUBJECT OF AGREEMENT

The subject of this agreement is to determine the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on Consumer Protection and the Distance Contracts Regulation regarding the sale and delivery of services whose characteristics and sales price are specified below, which the BUYER has ordered electronically from the postplus.net website owned by the SELLER.

2.1. SERVICE SPECIFICATIONS

Post+ digital marketing platform provides the following services:

  • WhatsApp bulk messaging service
  • Email marketing campaign management
  • Data collection and analysis tools
  • CRM integration support
  • Reporting and analytics dashboard
  • API access (on selected packages)

2.2. SERVICE PACKAGES

Trial Package

  • Duration: 14 days
  • WhatsApp Credits: 200
  • Email Credits: 200
  • WhatsApp Accounts: 1
  • Price: Free

Starter Package

  • WhatsApp Credits: 1,000/month
  • Email Credits: 1,000/month
  • WhatsApp Accounts: 1
  • Data Collection: Limited
  • API Access: No
  • Price: $7.99/month

Pro Package

  • WhatsApp Credits: 5,000/month
  • Email Credits: 5,000/month
  • WhatsApp Accounts: 3
  • Data Collection: Advanced

Enterprise Package

ARTICLE 3 - SERVICE FEE AND TAXES

3.1. PAYMENT INFORMATION

The total price of the service package selected by the Buyer, the amount including VAT, and the payment method are clearly stated on the order summary page.

3.2. TAXES

All prices are in Turkish Lira (TL) and include the current VAT rate (20%). In case of legal changes in tax rates, the new rate will apply.

3.3. PRICE CHANGES

The Seller reserves the right to change the prices of service packages. However, existing subscribers' fees remain fixed during the subscription period. Price changes only apply during the renewal period and are notified to the BUYER by email at least 30 days in advance.

ARTICLE 4 - PAYMENT METHOD AND DELIVERY

4.1. PAYMENT METHODS

The following payment methods are accepted:

  • Credit Card: Visa, Mastercard, American Express, Troy (Single or installment payment)
  • Debit Card: Debit cards
  • Wire Transfer: Bank transfer (For corporate customers)
  • EsnekPOS: Secure virtual POS infrastructure

4.2. BILLING

The subscription fee is automatically charged every month. The invoice is automatically generated on the payment date and sent to the BUYER's registered email address.

4.3. SERVICE ACTIVATION

The service is activated immediately after payment confirmation. The BUYER receives dashboard access credentials via email following payment confirmation and can start using the service.

4.4. RENEWAL

Subscriptions are automatically renewed. Unless the BUYER cancels, payment is automatically charged on the same date each month. Cancellation must be made before the next billing period.

ARTICLE 5 - RIGHT OF WITHDRAWAL

5.1. SCOPE OF RIGHT OF WITHDRAWAL

The BUYER may exercise the right of withdrawal within 7 (seven) days from the purchase of the service without providing any reason and without paying any penalty.

5.2. EXERCISING THE RIGHT OF WITHDRAWAL

To exercise the right of withdrawal:

  1. Send an email to support@postplus.net
  2. Write "Right of Withdrawal" in the subject line
  3. Specify your order number and cancellation request
  4. Refund process is completed within 14 business days

5.3. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal cannot be exercised in the following cases:

  • If the entire service has been completed (all credits have been used)
  • Services immediately performed at the BUYER's request
  • Free trial packages (as no fee was charged)

5.4. REFUND PROCESS

When the right of withdrawal is exercised:

  • Refund is made proportionally for unused credits
  • Refund is made to the credit card/bank account where payment was made
  • Refund period does not exceed 14 business days
  • Platform access is immediately terminated

ARTICLE 6 - RIGHTS AND OBLIGATIONS OF THE PARTIES

6.1. SELLER'S OBLIGATIONS

  • Provide the service uninterrupted and securely
  • Maintain platform uptime rate at 99.5% and above
  • Provide technical support (according to package features)
  • Protect personal data and comply with GDPR
  • Announce system maintenance in advance
  • Keep invoice and payment information accurate
  • Fulfill withdrawal right requests within the legal period

6.2. BUYER'S OBLIGATIONS

  • Provide accurate and up-to-date information
  • Pay subscription fees on time
  • Comply with Terms of Service
  • Use the platform in accordance with legal and ethical rules
  • Do not spam or send unauthorized messages
  • Ensure account security (password, 2FA, etc.)
  • Comply with GDPR requirements
  • Be responsible for content and messages

6.3. SERVICE INTERRUPTIONS

The SELLER has the right to suspend/terminate the service in the following cases:

  • Non-payment (after warning within 7 days)
  • Violation of terms of use
  • Spam or illegal activity
  • Creating security threats
  • Scheduled maintenance work (with prior notice)

ARTICLE 7 - PROTECTION OF PERSONAL DATA

7.1. DATA CONTROLLER

In accordance with the Law No. 6698 on Protection of Personal Data ("KVKK"), the data controller of the BUYER's personal data is the SELLER.

7.2. PROCESSED DATA

The following personal data is processed:

  • Identity information (name, surname, ID number)
  • Contact information (email, phone, address)
  • Invoice and payment information
  • Usage data (log, IP, device information)
  • Business information (company name, tax number, etc.)

7.3. USE OF DATA

Personal data is used for the following purposes:

  • Service delivery and fulfillment of contractual obligations
  • Billing and payment transactions
  • Providing customer support
  • Compliance with legal obligations
  • Improving service quality
  • Marketing activities if permitted

7.4. YOUR RIGHTS

BUYER's rights under GDPR:

  • Learning whether personal data is processed
  • Requesting information if processed
  • Learning the purpose of processing
  • Domestic/international transfer information
  • Requesting correction
  • Requesting deletion/destruction
  • Being informed when action is taken
  • Objecting to automated systems
  • Requesting compensation for damages

ARTICLE 8 - DISPUTE RESOLUTION

8.1. COMPETENT COURTS AND ENFORCEMENT OFFICES

In disputes arising from this agreement:

  • Consumer Arbitration Committees at the BUYER's place of residence or where the goods/services were purchased, within the monetary limits determined annually in December by the Ministry of Industry and Trade
  • Istanbul Courts and Enforcement Offices at the BUYER's or SELLER's place of residence are authorized

8.2. CONSUMER ARBITRATION COMMITTEE

Consumer arbitration committee monetary limits determined for 2025:

  • Provincial Consumer Arbitration Committees: up to 105,000 TL
  • District Consumer Arbitration Committees: up to 35,000 TL

8.3. APPLICABLE LAW

The laws of the Republic of Turkey apply to this agreement. Particularly the following legislation provisions are valid:

  • Law No. 6502 on Consumer Protection
  • Distance Contracts Regulation
  • Law No. 6698 on Protection of Personal Data
  • Law No. 6563 on Regulation of Electronic Commerce

ARTICLE 9 - EFFECTIVE DATE

This agreement enters into force when approved electronically by the BUYER. By placing an order, the BUYER is deemed to have accepted all provisions of this agreement.
